Applying for an Indian Work Permit
Most non-Indian citizens travelling to India to engage in employment will do so based on sponsorship from a company based In India. Although an Indian work visa does not provide a route to permanent residency, it may be extended as required in increments of one year. Candidates must provide a range of documentary evidence to support their application including proof of residence and a letter of confirmation which details the position being offered. It will also be necessary to provide a current, valid passport as part of the application.

Intra Company Transfers allow companies based in India to transfer crucial staff members from overseas subsidiaries and branches to work in India for a specific period. Intra Company Transfers are used where a position or project requires the skills and expertise of an overseas employee who has experience in the Indian company’s services or products.
Although Intra Company Transfer visas for India are similar in purpose to ICTs in the USA, UK and a number of other popular destinations, once more, like Indian work permits, the requirements on the part of the applicant are loosely defined. Intra Company Transfers are issued on a case-by-case basis and will be granted at the Indian migration officer’s discretion. The key principles of the ICT are that the transferring employee must work for the sponsoring Indian company and must be able to perform the specific role or project. However, Indian ICT visas for relocating to India on a temporary basis do have some qualifying criteria. Applicants are normally required to have a minimum level of education which is usually defined as a four-year university degree or similar. Applications will also be considered against the likelihood of an Indian citizen or permanent resident being displaced by the arrival of the visa holder. Work permits and ICT applications must not prevent an existing citizen or resident from obtaining employment.
Indian Work Permits – Spouse and Dependent Immigration
Indian work permits, although issued as a temporary immigration service may be extended as required and as such, a candidate in possession of an Indian work permit visa may live and work in India for a number of years. With this in mind, the spouse or partner and dependents of the main applicant may also relocate to India for the same duration although they will not automatically be granted the right to take up employment. Living and working in India for dependents of a work permit holder will involve them qualifying for their own permit for work.
