Canadian Family Visa - Benefits
As with family immigration to any destination, the key benefits of a Canadian family visa lie in the fact that immigrating is entirely based upon the candidate’s familial ties to Canada. Applicants do not need to undergo a points based assessment or contribute business skills and will not be assessed on their qualifications or their age. Immigrating to Canada in this way allows a candidate to obtain permanent residency in Canada and ultimately a candidate may apply to become a Canadian citizen once the three-year minimum residency requirement is met. Successful applicants will be entitled to begin living and working in Canada without restriction for any employer they choose and a pre-arranged job offer is not required.
Who Qualifies for a Canadian Family Visa?
In Canada, family visas include the spouse or partner of an existing Canadian citizen or permanent resident The husband, wife, civil, common-law or conjugal partner of a sponsor may relocate to Canada indefinitely and may work in Canada upon arrival. In addition, family immigration also applies to the following categories.
- Dependent children under the age of 22 may immigrate to Canada in this way as long as they do not have a spouse or common-law partner. This category also applies to adopted children.
- Children who the sponsoring citizen or permanent resident intends to adopt are also included in this Canadian immigration service. In these circumstances, applicants must be under the age of 18.
- Siblings, grandchildren, nieces and nephews may immigrate if they are orphaned, under the age of 18 and are neither married nor in a common-law relationship.
- Parents and grandparents may be sponsored
Any relative not expressly included in any of the above categories may be sponsored so long as the sponsor does not have another relative in one of the aforementioned categories who they could sponsor, or who is already present in Canada with a grant of permanent residency or citizenship.
NB: Where a candidate is sponsoring a souse who is already present in Canada at the time of application, dependent children will automatically be included whether they are present in Canada or not.
Family Visa Sponsor Requirements
All sponsors must be related to the applicant in one of the categories described above and must have either a grant of Canadian citizenship or permanent residency. Sponsors must be at least 18 years of age and must have sufficient financial stability t allow them to sponsor the applicant for an agreed period. This period will normally be between 3 and 10 years. It is important t o note that the sponsor’s ability to finance the applicant until such time as they are self supporting is of key importance to the visa application. If a sponsor has previously sponsored a family class immigration applicant who subsequently became dependent upon benefits, they may not be permitted to sponsor another candidate in the future.
Canada Sponsor Visas – Sponsorship Agreements
With the exception of those citizens or permanent resident sponsoring a candidate to live and work in Quebec, all Canadian sponsors must sign an undertaking with the Minister of Citizenship and Immigration in which they commit to sponsoring the applicant. A sponsorship agreement must also be signed by both the the sponsor and the applicant which sets out the expectations and obligations of both parties. The sponsor must agree to support the applicant inimically for as long as it takes the latter o become self-sufficient. In turn, the applicant must endeavour to become financially independent as soon as they are able to.
